DMCA / Copyright Policy

GEXRadar LLC ("GEXRadar") respects the intellectual property rights of others and enforces its own. This DMCA / Copyright Policy explains how to report claimed copyright infringement to us, how we respond, and how we pursue infringement of GEXRadar's own works. This Policy supplements our Terms of Service and EULA and is incorporated into them by reference.

1. Overview

GEXRadar's software, extensions, indicator packages, analytics outputs, visual designs, and brand are protected by United States and international copyright, trademark, trade dress, and trade secret laws. Copying, cloning, or redistributing these works without authorization is prohibited and actively enforced.

2. Our Copyright and Enforcement

The GEXRadar platform and the GEXRadar extensions and indicator packages — including the TradingView browser extension and Pine Script indicator and the NinjaTrader 8, ATAS, MotiveWave, Sierra Chart, and Quantower indicator packages, together with all source code, indicator and level-derivation logic, analytics outputs, visual design, color schemes, look and feel, icons, graphics, documentation, and the GEXRADAR name and logo — are original works owned by GEXRadar LLC.

GEXRadar monitors for unauthorized copies, clones, imitations, and impersonations of its works and brand. Where infringement is identified, GEXRadar may pursue any and all available remedies, including without limitation:

• Takedown notices under the Digital Millennium Copyright Act (17 U.S.C. § 512) and equivalent foreign laws, submitted to hosting providers, content delivery networks, browser-extension and application stores, and online marketplaces;
• Complaints to domain registrars and, where applicable, proceedings under the Uniform Domain-Name Dispute-Resolution Policy (UDRP);
• Claims under 17 U.S.C. § 1201 for circumvention of license keys, obfuscation, or other technological protection measures;
• Trademark and trade dress enforcement, including complaints to platforms and advertising networks; and
• Civil action seeking injunctive relief, actual and statutory damages, and attorneys' fees where available.

Copying GEXRadar's code, visual output, level logic, or distinctive presentation — in whole or in part, with or without modification, including by reimplementing it so as to be substantially similar — constitutes copyright infringement and unfair competition. You acknowledge that such copying would cause GEXRadar irreparable harm for which monetary damages alone would be inadequate.

3. Reporting Infringement to Us (Notice)

If you believe that content made available through the Service infringes a copyright you own or control, please send a written notice to our designated contact at [email protected] with the subject line "DMCA". To be effective, your notice must include the information required by 17 U.S.C. § 512(c)(3), namely:

• A physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
• Identification of the copyrighted work claimed to have been infringed;
• Identification of the material that is claimed to be infringing and its location, with enough detail for us to locate it;
• Your contact information, including name, address, telephone number, and email address;
• A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; and
• A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

We will review properly submitted notices and, where appropriate, remove or disable access to the material and take further action consistent with applicable law. Submitting a false or bad-faith notice may expose you to liability for damages under 17 U.S.C. § 512(f).

4. Counter-Notice

If you believe your material was removed or disabled by mistake or misidentification, you may submit a counter-notice to [email protected] containing: your physical or electronic signature; identification of the material and its prior location; a statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification; your name, address, and telephone number; and a statement consenting to the jurisdiction of the federal court for the judicial district in which your address is located (or, if outside the United States, any judicial district in which GEXRadar may be found), and that you will accept service of process from the party who filed the original notice.

5. Repeat Infringers

GEXRadar will, in appropriate circumstances and at its sole discretion, terminate the accounts of users who are determined to be repeat infringers.

6. Trademark and Impersonation

The GEXRADAR name and logo are trademarks of GEXRadar LLC. Registering domain names, social-media handles, or advertising keywords that are identical or confusingly similar to GEXRadar's marks, or operating a site or product that impersonates GEXRadar or falsely suggests affiliation, is prohibited and will be enforced through the measures described in Section 2, including UDRP proceedings and complaints to registrars, platforms, and search providers. Report suspected impersonation to [email protected].
